These Terms of Service govern your access to and use of the services provided by Sumaiyah Technology Solutions Sdn. Bhd. (Registration No. 202401049816 (1595660-W)), trading as Bereh, including its website, digital workspace, applications, and related services. By creating an account or using the service, you agree to these terms.
1. Eligibility and authority
You must be legally capable of entering into an agreement. If you use Bereh for an organisation, you confirm that you are authorised to accept these terms on its behalf.
2. Accounts and tenant workspaces
- You must provide accurate registration and billing information.
- You are responsible for protecting account credentials and controlling authorised users.
- Each tenant is responsible for assigning suitable roles and permissions to its users.
- You must promptly notify us if you suspect unauthorised access or misuse.
3. Subscriptions and payments
Access to paid applications is subject to the selected subscription, applicable fees, and payment status. Prices, billing periods, taxes, discounts, and prorated charges are shown during subscription or payment. Unless otherwise stated, fees already incurred are non-refundable.
4. Acceptable use
You must not use Bereh to:
- Break any applicable law or infringe another person's rights.
- Upload malicious code, disrupt the service, or attempt unauthorised access.
- Send spam, fraudulent communications, or harmful content.
- Probe, copy, reverse engineer, or circumvent service restrictions except where permitted by law.
- Use the service in a way that creates unreasonable risk or load for Bereh or other users.
5. Customer data
You retain responsibility for information entered into your tenant workspace. You confirm that you have the right to collect, use, and instruct us to process that information. You are responsible for the accuracy, legality, and appropriate retention of your data.
6. Intellectual property
Bereh and its licensors retain all rights in the service, software, design, documentation, trademarks, and related materials. These terms grant you a limited, non-exclusive, non-transferable right to use the service during an active subscription in accordance with these terms.
7. Third-party services
Some features may connect to payment gateways or other third-party services. Their separate terms and policies apply to their services. Bereh is not responsible for a third party's independent systems or actions.
8. Service changes and availability
We may improve, update, replace, or discontinue features. We will use reasonable efforts to provide notice when a material change significantly affects active subscribers. Service availability is further described in the applicable Service Level Agreement.
9. Suspension and termination
We may restrict or suspend access when fees remain unpaid, these terms are breached, security is at risk, or continued access may harm Bereh or others. You may stop using the service at any time, subject to outstanding payment obligations and applicable retention requirements.
10. Disclaimers and limitation of liability
Bereh is provided on an as-available basis, subject to applicable law and any express service commitments. To the extent permitted by law, Bereh is not liable for indirect, incidental, special, or consequential loss, loss of profits, or loss caused by circumstances outside our reasonable control.
11. Indemnity
To the extent permitted by law, you are responsible for claims and reasonable costs arising from your unlawful use of the service, your content, or your material breach of these terms.
12. Governing law
These terms are governed by the laws of Malaysia. The parties will first attempt to resolve disputes in good faith before pursuing available legal remedies.
13. Changes to these terms
We may update these terms to reflect service, legal, or operational changes. The current version will be published on this page with its effective date. Continued use after an update means you accept the revised terms.
14. Order of precedence
If these Terms conflict with another document governing the service, a separately executed written agreement or order form expressly addressing the conflicting matter will take precedence, followed by the applicable Service Level Agreement and then these Terms. The Privacy Policy and Personal Data Protection Notice govern the handling of personal data within their respective scope.
